Commonwealth Bank BBQ for Prostate Cricket Competition

  1. Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia BBQ for Prostate Cricket Competition (the “Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by the winner(s) is deemed as acceptance of these Conditions of Entry.

  2. The Promoter is the Commonwealth Bank of Australia ABN 48 123 123 124 of Level 3, 48 Martin Place, Sydney telephone +61 2 9378 5982 (the “Promoter”).

  3. The Promotion commences at 09.00 (Sydney time) on 1 September 2009 and closes at 18.00 (Sydney time) on 15 October 2009 (the “Promotion Period”).

  4. Entry into the Promotion is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”):

    • the person must be over the age of 18 years and a resident of Australia;

    • the person must be available to attend a cricket match in the nearest capital city to which they reside on one of the following dates:

      • Australia vs Pakistan – 22 January – Brisbane

      • Australia vs Pakistan – 24 January – Sydney

      • Australia vs Pakistan – 26 January – Adelaide

      • Australia vs Pakistan – 29 January – Perth

      • Australia vs Pakistan – 31 January – Perth

      • Australia vs West Indies – 7 February – Melbourne

      • Australia vs West Indies – 9 February – Adelaide

      • Australia vs West Indies – 12 February – Sydney

      • Australia vs West Indies – 14 February – Brisbane

      • Australia vs West Indies – 19 February - Melbourne

    • are not members of the immediate family of employees of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter) and
    • have not already entered the Promotion

  5. To enter, you must satisfy the Eligibility Requirements and during the Promotion Period:

    • Go to www.prostate.org.au or www.prostate.org.au/cricket

    • Donate the proceeds of your fundraising BBQ or event to the Prostate Cancer Foundation of Australia (PCFA) using the online donation form

    • Tick the box at the bottom of the donation form to enter the competition: “I wish to enter the Commonwealth Bank Cricket Competition”

  6. Chance plays no part in winning this Promotion. The person making the highest online donation to the PCFA and opts in to enter the competition during the Promotion Period will be declared the winner. Donations will be tallied by the Prostate Cancer Foundation of Australia at 51 – 53 Chandos Street, St Leonards, NSW, 2065 on 23 October 2009. Winners will be notified by email or phone within seven (7) days of the date of judging.

  7. There will be one prize. The winner will be given two tickets to a 2010 Commonwealth Bank Series cricket match in the nearest capital city to which they reside (as detailed in the schedule in section 4), along with two (2) Commonwealth Bank Series replica shirts and caps. The prizewinner (only) will also be escorted onto the pitch before the match for an exclusive photo opportunity with the captains of both teams. If the prizewinner resides more than 200km from their state capital, or in Tasmania or the Northern Territory, a flight (or applicable transport) to the nearest match venue, accommodation for two (2) persons for one (1) night (to a maximum value of $300), plus transfers to and from the airport/ transport hub (to a maximum value of $100) will be included in the prize. Total prize valued at AUD1500.00.

  8. If more than one (1) fundraiser donates the same highest amount during the Promotion Period, a tie-breaker question will be sent by email or mail to the joint highest fundraisers. The tie-breaker question will request a response in 25 words or less and the most original and creative will be judged the winner. Entries will be judged by Lauren Larkins of Commonwealth Bank of Australia on 30 October 2009 at Level 3, 48 Martin Place. Winners will be notified by email or mail within seven (7) days of the date of judging.

  9. The maximum total prize value is approximately AUD1500.00 based on the recommended retail value provided by the supplier and is correct at the time of printing. The Promoter accepts no responsibility for any variation in prize value.

  10. Prizes are subject to:

    • the terms and conditions of booking, accommodation, carriage and use of any suppliers. Where they contradict these Conditions of Entry, these Conditions of Entry will prevail.

    • seat and room availability at the time of booking.

    • blackout periods including all Australian school holidays (in all Australian states and territories). ??

  11. All bookings are to be made by the Promoter and/ or their agencies.

  12. The airline tickets do not attract any loyalty program award points.

  13. Unless expressly stated all other expenses including travel insurance, all government and airport taxes (excluding fuel or other surcharges), passports, visas, spending money, meals, beverages, optional excursions whilst using the prize, transfers to and from departure points, additional accommodation and insurance will be the sole responsibility of each Winner.

  14. By acceptance of the prize the winner agrees to the name of the winner being published on www.prostate.org.au and in The Australian on 30 November 2009

  15. Prizes are not transferable or exchangeable and cannot be taken as cash. The winners accept the prize ‘as is’ and acknowledge that the Promoter accepts no responsibility for any tax implications that may arise from the prize. The winner should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser.

  16. The Promoter’s decision is final and no correspondence will be entered into. The Promoter will arrange for delivery of the prizes within Australia, after the selection of the winning entries, by mutual agreement with the winner(s).

  17. The Promoter will use its best endeavours to provide the prizes listed. If the prizes are unavailable for whatever reason, the Promoter reserves the right to substitute for that prize or item for a prize or item of an equivalent value subject to any written directions given under applicable trade promotion laws and regulations.

  18. In the event that for any reason whatsoever a winner does not take an element of the prize at the time agreed by the Promoter then that element of the prize will be forfeited by that winner and cash will not be awarded in lieu of that element of the prize.

  19. The Promoter reserves the right to request that the winner demonstrates their eligibility for the prize as a condition of receipt of a prize. Identification and proof of residence considered suitable for verification is at the discretion of the Promoter.

  20. If any winner fails to claim their prize by 29 November 2009 the Promoter may select further winning entries on 30 November 2009 subject to any written directions given under applicable trade promotion laws and regulations. These winners names will be published on www.prostate.org.au and in The Australian on 12 December 2009.

  21. If for any reason this Promotion is not capable of running as planned (including, but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may take any action that may be available including cancelling, terminating, modifying or suspending the Promotion. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.

  22. Any cost associated with accessing the promotional website is the dependent on the Internet Service Provider used and is the responsibility of the entrant.

  23. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid. The Promoter reserves the right to verify the validity of entries and to disqualify any entry that is not in accordance with these Conditions of Entry.

  24. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person’s computer related to or related to or resulting from participation in or downloading any materials in this Promotion.

  25. To the extent permitted by law, the Promoter and its related entities and its and their respective directors, officers, employees and agents, will not be liable for any personal injury, loss or damage, whatsoever which is suffered or sustained (including, but not limited to) indirect or consequential, financial or other loss) to or by a winner or any person accompanying a winner.

  26. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and contact you regarding information on products or services that may be of benefit or interest to you. The Promoter may communicate personal information to external providers and organisations to which it may outsource certain functions. You may access and correct your information by contacting the Privacy Officer, Customer Relations, Commonwealth Bank Group, Reply Paid 41, NSW 2001, by calling the Promoter on 13 2221 or by visiting any branch of the Promoter.   27. These Conditions of Entry shall be governed by the laws of New South Wales and each entrant agrees to submit to the non-exclusive jurisdiction of the New South Wales courts.
